Former Supreme Court Associate Justice Antonio Carpio has clarified that the increased military air activity by the United States within Philippine airspace should not be seen as a cause for alarm. According to Carpio, the US exercises its freedom of navigation and overflight rights in the West Philippine Sea (WPS) under international law. The WPS is a disputed territory claimed by China but also recognized by the Philippines as part of its exclusive economic zone.
Carpio pointed out that the 1951 Mutual Defense Treaty between the US and the Philippines allows for joint military exercises, including in airspace over Philippine waters. He emphasized that this cooperation does not infringe on Philippine sovereignty but rather enhances the country’s defense capabilities. Carpio stated that any concerns about the increased military activity should be addressed through diplomatic channels, not through raising alarms about potential threats to national security.
