Senate’s Role in Treaty Withdrawal Sparks Debate Amid ICC Ruling

Retired Supreme Court Justice Antonio Carpio has urged the Senate to assert its power in treaty withdrawal following a recent decision on an International Criminal Court (ICC) case.

The SC dismissed petitions challenging President Rodrigo Duterte’s decision to end the country’s membership in the ICC, which is studying whether to conduct a full-blown investigation into his war on drugs.

Carpio warned that if the Senate does not assert its prerogative to concur, it will lose its power to do so in the future. He emphasized the importance of the separation of powers among branches of government and the need for clear boundaries between executive and legislative actions.

The SC ruling noted that the Senate refrained from passing a resolution indicating its concurrence in withdrawing from the Rome Statute, which created the ICC.
