Retired Supreme Court Justice Antonio Carpio has expressed skepticism over former President Rodrigo Duterte’s proposal to separate Mindanao from the Philippines. According to Carpio, such a move would be impossible due to the 1987 Constitution, which guarantees the integrity of the national territory.
Carpio pointed out that the Armed Forces of the Philippines would oppose any attempt to secede, as it is their duty to secure the country’s territorial integrity. He also emphasized that no impartial government official in Mindanao would support such a move, as it would be against the Code of Conduct and could result in dismissal from public service.
Duterte’s plan to gather signatures for the secession movement has raised concerns about inciting sedition. However, Carpio believes that this does not constitute an overt act, which is required for sedition. He also noted that Duterte’s statement lacks violence or intimidation.
