The transfer of PhilHealth excess funds to the national treasury has sparked concerns over constitutional powers and potential misuse of public funds.
A letter from 1Sambayan coalition, led by retired Supreme Court Associate Justice Antonio Carpio, argues that the Department of Finance’s (DOF) Circular 003-2024 violates the Constitution by delegating power to the Finance Secretary.
The coalition fears that this move may be considered technical malversation and even plunder, given the specific purpose of PhilHealth funds for universal healthcare.
As a result, 1Sambayan seeks the recall of the directive and is prepared to test its validity in the Supreme Court if necessary.
