Duterte’s ICC Case and the Unlikely Interim Release

In a recent interview, Justice Antonio Carpio shared his insights on the International Criminal Court (ICC) case against former President Rodrigo Duterte. As a renowned expert on international law, Carpio shed light on the complexities of the case and the likelihood of an interim release for Duterte.

Carpio emphasized that the ICC’s primary concern is not with Duterte’s personal actions, but rather with the alleged crimes committed during his presidency. The retired Supreme Court Senior Associate Justice noted that the ICC has already issued a warrant for Duterte’s arrest, citing credible evidence of crimes against humanity and war crimes.

When asked about the possibility of an interim release, Carpio was clear in his assessment: ‘It’s unlikely.’ He explained that under the Rome Statute, which governs the ICC, interim releases are only granted in exceptional circumstances. In this case, the prosecution has presented strong evidence against Duterte, making it improbable for him to be released on bail.

Carpio’s expertise and knowledge of international law have been instrumental in shaping the Philippine government’s stance on the ICC. His unwavering commitment to upholding justice and accountability has earned him recognition as a leading voice in the country’s legal community.
