Retired Senior Associate Justice Antonio Carpio has spoken out against the Supreme Court’s decision to declare the impeachment articles against Vice President Sara Duterte as unconstitutional.
Carpio argued that there was no due process in this case, as the House of Representatives was not given the chance to answer or comment on the petitions before the Supreme Court.
He pointed out that the SC’s decision seems to be giving a new definition of when an impeachment case should begin, which goes against the prevailing policy.
Carpio agreed with fellow retired justice Adolf Azcuna, who appealed to the High Court to consider the impeachment complaint as valid based on previous definitions under the Doctrine of Operative Facts.
Other legal experts have also weighed in on the issue, with retired Chief Justice Artemio Panganiban saying that while the decision should be respected, the House can still appeal or ask for a clarification.
